POLISI PEMBAYARAN

  • Deposit RM1000/pax
  • Bayaran ansuran diterima
  • 90 hari : (50% daripada bayaran perlu dijelaskan – jika melibatkan tiket penerbangan antarabangsa)
  • 60 hari : (50% daripada bayaran perlu dijelaskan – jika melibatkan tiket penerbangan domestik)
  • 45 hari : (bayaran penuh perlu dijelaskan)

 

POLISI PEMBATALAN

  • Bayaran deposit TIDAK AKAN DIPULANGKAN (NON-REFUNDABLE) jika peserta mahu membatalkan pakej yang telah diambil. TETAPI peserta boleh memilih salah satu dari pilihan berikut:
    • Menukar tarikh pakej (1 kali sahaja) – tarikh penukaran hanya boleh dibuat dalam tempoh 12 bulan dari tarikh trip asal ATAU
    • Tukar dengan peserta lain (hanya apabila tiket penerbangan antarabangsa/ domestik belum lagi dibeli)
  • Sebarang pertukaran (pilihan) di atas perlulah dibuat sekurang-kurangnya:
    • 90 hari sebelum trip bermula : hanya 50% daripada bayaran, akan dipulangkan dan (Jika tiket penerbangan telah dibeli, keseluruhan kos penerbangan ditanggung sepenuhnya oleh peserta).
    • 45 hari sebelum trip bermula : Bayaran penuh yang telah dibuat, tidak akan dipulangkan.

 

TERMA & SYARAT

  • Perlepasan ‘join tour’ dan ‘small group tour’ adalah tertakluk kepada JUMLAH PERLEPASAN MINIMUM PERSERTA.
    • Join tour : 20 pax / 24 pax / 32 pax bergantung kepada pakej
    • Small group tour / deluxe tour : 6 / 8 / 10 pax bergantung kepada pakej
  • Justeru itu, tarikh perlepasan adalah TERTAKLUK KEPADA PERUBAHAN dalam jangka masa 1 hingga 7 hari dari tarikh perlepasan asal. Peserta akan dimaklumkan selewatnya 30 hari sebelum berlepas.
  • Pihak syarikat TIDAK BERTANGGUNGJAWAB ke atas sebarang pembelian awal tiket penerbangan domestik ‘connecting flight’ / pakaian musim tertentu / lain-lain kos yang terlibat seandainya trip terpaksa di batalkan atas apa jua faktor.
  • Pihak syarikat BERHAK untuk membuat penukaran pada jadual program yang dicadangkan mengikut kesesuaian dan kelancaran pakej. Sebarang perubahan jadual mungkin berlaku contohnya seperti perubahan pada waktu penerbangan disebabkan oleh faktor cuaca dan sebagainya.
  • Sebarang perubahan yang diminta oleh peserta melibatkan penambahan kos, kos tersebut akan ditanggung oleh peserta.
  • Sebarang perubahan waktu penerbangan adalah diluar bidang kuasa kami. Pihak kami TIDAK AKAN BERTANGGUNGJAWAB jika berlaku perubahan waktu / penangguhan jadual penerbangan.
  • Pihak syarikat TIDAK AKAN BERTANGGUNGJAWAB sekiranya peserta di didapati positif covid-19 atau menghadapi apa jua masalah kesihatan sebelum / semasa / selepas trip berlangsung. Sebarang kos-kos yang terlibat adalah tanggungan peserta atau tuntutan boleh dilakukan berdasarkan polisi ‘travel insurance’ yang di beli sendiri oleh peserta.
  • Apabila deposit telah dibuat, dengan ini peserta bersetuju dengan syarat yang telah ditetapkan oleh syarikat.

PAYMENT POLICY

  • Deposit RM1000 per pax

  • Installment payments are accepted

  • 90 days before departure: 50% of the total payment must be made (if international flight tickets are involved)

  • 60 days before departure: 50% of the total payment must be made (if domestic flight tickets are involved)

  • 45 days before departure: Full payment must be made

 

 

CANCELLATION POLICY

The deposit payment is NON-REFUNDABLE if the participant decides to cancel the booked package. However, the participant may choose one of the following options:

  • Change the package date (one-time only) – the new date must be within 12 months from the original trip date OR

  • Transfer the package to another participant (only if international/domestic flight tickets have not been purchased)

Any changes (as listed above) must be made at least:

  • 90 days before the trip starts: Only 50% of the payment will be refunded. If flight tickets have been purchased, the full flight cost will be borne by the participant.

  • 45 days before the trip starts: No refund will be provided for the full amount paid.

 

 

TERMS & CONDITIONS

  • Departure for join tours and small group tours is subject to the minimum number of participants required:

    • Join tour: 20 pax / 24 pax / 32 pax, depending on the package

    • Small group tour / deluxe tour: 6 / 8 / 10 pax, depending on the package

  • Therefore, the departure date is subject to changes within 1 to 7 days from the original departure date. Participants will be notified at least 30 days before departure.

  • The company is NOT responsible for any early purchases of domestic flight tickets (connecting flights), seasonal clothing, or other costs incurred if the trip is canceled for any reason.

  • The company reserves the right to make changes to the proposed itinerary for the smooth operation of the package. Schedule changes may occur due to factors such as flight schedule changes caused by weather conditions, etc.

  • Any changes requested by participants that involve additional costs will be borne by the participants.

  • Any changes in flight schedules are beyond our control. We WILL NOT BE RESPONSIBLE for any flight schedule changes or delays.

  • The company WILL NOT BE RESPONSIBLE if a participant is found positive for COVID-19 or faces any health issues before/during/after the trip. Any related costs must be borne by the participant, or claims can be made based on the travel insurance policy purchased by the participant.

  • Once the deposit is made, the participant agrees to the terms and conditions set by the company.

Dengan membuat pembayaran deposit, peserta telah membaca dan bersetuju dengan TERMA & SYARAT PEMBAYARAN dan PERJANJIAN PERKHIDMATAN PELANCONGAN

Jika tidak bersetuju, peserta diberi pilihan untuk mendapatkan bayaran balik ‘refund’ penuh dalam masa 24 jam (hari kerja).

PERJANJIAN PERKHIDMATAN PELANCONGAN
(Travel Services Agreement)

Perjanjian ini dibuat pada tarikh yang dinyatakan dalam invois di antara:
JOMVENTURES TRAVEL & TOURS SDN BHD
(No. Syarikat: 202201003593)

sebuah agensi pelancongan berlesen di bawah Kementerian Pelancongan, Seni dan Budaya Malaysia dan tertakluk kepada Akta Industri Pelancongan 1992
(selepas ini dirujuk sebagai “Syarikat”)

DAN
Peserta trip
(selepas ini dirujuk sebagai “Peserta”)

PRIVATETOUR.MY adalah jenama yang dikendalikan sepenuhnya oleh Syarikat. Semua kontrak, liabiliti dan transaksi adalah di bawah Jomventures Travel & Tours Sdn Bhd.

1. TAKRIF
1.1 “Pakej” bermaksud perkhidmatan pelancongan seperti dinyatakan dalam quotation atau invois rasmi.
1.2 “Pembekal” bermaksud pihak ketiga termasuk syarikat penerbangan, hotel, pengangkutan dan operator aktiviti.
1.3 “Force Majeure” bermaksud kejadian di luar kawalan munasabah Syarikat.

2. SKOP PERKHIDMATAN
2.1 Syarikat akan menyediakan perkhidmatan seperti dinyatakan secara bertulis dalam quotation atau invois rasmi sahaja.
2.2 Sebarang perkhidmatan yang tidak dinyatakan secara bertulis adalah tidak termasuk dan tertakluk kepada caj tambahan.
2.3 Syarikat bertindak sebagai ejen perantara kepada Pembekal dan tidak bertanggungjawab atas kecuaian atau kegagalan Pembekal.

3. SEBUTHARGA
3.1 Sebutharga sah selama tujuh (7) hari dan tertakluk kepada ketersediaan.
3.2 Harga hanya dijamin selepas deposit diterima sepenuhnya.
3.3 Syarikat berhak menarik balik sebutharga sebelum deposit diterima.

4. PEMBAYARAN
4.1 Deposit
Deposit sebanyak RM500 seorang melainkan dinyatakan dengan jumlah yang lain adalah wajib dan tidak boleh dipulangkan. (Rujuk pada bahagian 5.0)
Semua bayaran tidak boleh dipindah milik tanpa kelulusan bertulis Syarikat.

4.2 Jadual Bayaran – JOIN TOUR / OPEN TRIP / GIT
(a) Sebulan selepas deposit:
Eropah: RM2,000 seorang
Jepun: RM1,000 seorang
Asia Tenggara: RM800 seorang
(b) Seratus dua puluh (120) hari sebelum tarikh berlepas:
Minimum 50% daripada jumlah harga pakej mesti dijelaskan.
(c) Empat puluh lima (45) hari sebelum tarikh berlepas:
Bayaran penuh mesti dijelaskan.

4.3 Jadual Bayaran – PRIVATE TOUR / PRIVATE TRIP / FIT
(a) Tujuh puluh lima (75) hari sebelum tarikh berlepas:
Minimum 50% daripada jumlah harga pakej mesti dijelaskan.
(b) Empat puluh lima (45) hari sebelum tarikh berlepas:
Bayaran penuh mesti dijelaskan.

4.4 Kegagalan Bayaran
Syarikat berhak:
(a) Membatalkan tempahan;
(b) Melucutkan semua bayaran;
(c) Menamatkan Perjanjian tanpa liabiliti;
(d) Menuntut baki bayaran jika komitmen telah dibuat kepada Pembekal.

5. PEMBATALAN DAN PERTUKARAN
5.1 Deposit tidak boleh dipulangkan.
5.2 Pertukaran tarikh atau nama hanya dibenarkan sekali dan tertakluk kepada tiket belum dikeluarkan.
5.3 Jika tiket telah dikeluarkan, kos penerbangan ditanggung Peserta.
5.4 Pembatalan dalam tempoh 45 hari sebelum berlepas menyebabkan semua bayaran hangus (100%).

6. HARGA DAN PELARASAN
6.1 Harga adalah berdasarkan kadar semasa pada tarikh invois.
6.2 Syarikat berhak menjual pakej pada harga berbeza tanpa obligasi pelarasan.
6.3 Tiada tuntutan “price match”.
6.4 Sebarang kenaikan kos pembekal selepas pengesahan adalah tanggungan Peserta.

7. ITINERARI
Syarikat berhak mengubah aturcara atas faktor keselamatan, cuaca atau arahan pihak berkuasa tanpa pampasan.

8. DOKUMEN DAN VISA
Peserta bertanggungjawab memastikan dokumen lengkap dan sah. Syarikat tidak bertanggungjawab atas penolakan imigresen.

9. TINGKAH LAKU PESERTA
Syarikat berhak menamatkan penyertaan Peserta yang melanggar undang-undang atau mengganggu perjalanan tanpa pemulangan bayaran.

10. KESIHATAN DAN INSURANS
Segala risiko kesihatan adalah tanggungan Peserta.
Peserta digalakkan mengambil insurans perjalanan.

11. FORCE MAJEURE
Syarikat tidak bertanggungjawab atas kejadian di luar kawalan munasabah. Refund tertakluk kepada bayaran diterima daripada Pembekal.

12. HAD LIABILITI
Liabiliti maksimum Syarikat terhad kepada jumlah bayaran diterima. Syarikat tidak bertanggungjawab atas kerugian tidak langsung.

13. INDEMNITI
Peserta bersetuju menanggung rugi Syarikat daripada sebarang tuntutan akibat pelanggaran Perjanjian atau salah laku Peserta.

14. CHARGEBACK
Peserta tidak boleh membuat pertikaian pembayaran tanpa asas munasabah selepas persetujuan bertulis.

15. PERLINDUNGAN DATA (PDPA)
Data Peserta boleh diproses bagi tujuan pengurusan perjalanan selaras dengan Akta Perlindungan Data Peribadi 2010.

16. TIMBANG TARA
Pertikaian hendaklah dirujuk kepada timbang tara di Malaysia selaras dengan Akta Timbang Tara 2005.

17. HAD MASA TUNTUTAN
Sebarang tuntutan hendaklah dibuat dalam tempoh 12 bulan dari tarikh tamat perjalanan.

18. ENTIRE AGREEMENT
Perjanjian ini menggantikan semua perbincangan terdahulu.

19. SEVERABILITY
Jika mana-mana peruntukan tidak sah, peruntukan lain kekal berkuat kuasa.

20. WAIVER
Kegagalan menguatkuasakan mana-mana hak tidak dianggap pelepasan hak tersebut.

21. ASSIGNMENT
Peserta tidak boleh memindahkan hak tanpa kebenaran bertulis Syarikat.

22. TANDATANGAN ELEKTRONIK
Tandatangan elektronik adalah sah dan mengikat.

23. UNDANG-UNDANG DAN BIDANG KUASA
Perjanjian ini tertakluk kepada undang-undang Malaysia.
Sebarang pertikaian hendaklah dirujuk kepada Mahkamah Malaysia.

Travel Agreement Services (English)

Updated on 6 May 2026, applicable for bookings made from 7 May 2026 onwards

By making the deposit payment, the participant confirms that they have read and agreed to the PAYMENT TERMS & CONDITIONS and the TRAVEL SERVICES AGREEMENT.

If the participant does not agree, they may request a full refund within twenty-four (24) working hours.

TRAVEL SERVICES AGREEMENT
(Travel Services Agreement)

This Agreement is made on the date stated in the invoice between:

JOMVENTURES TRAVEL & TOURS SDN BHD
(Company No.: 202201003593)

a licensed travel agency under the Ministry of Tourism, Arts and Culture Malaysia and governed by the Tourism Industry Act 1992
(hereinafter referred to as the “Company”)

AND

Trip Participant
(hereinafter referred to as the “Participant”)

PRIVATETOUR.MY is a brand fully operated by the Company. All contracts, liabilities, and transactions are under Jomventures Travel & Tours Sdn Bhd.

  1. DEFINITIONS

1.1 “Package” refers to the travel services stated in the official quotation or invoice.

1.2 “Supplier” refers to third parties including airlines, hotels, transportation providers, and activity operators.

1.3 “Force Majeure” refers to events beyond the reasonable control of the Company.

  1. SCOPE OF SERVICES

2.1 The Company shall provide only the services stated in writing in the official quotation or invoice.

2.2 Any services not stated in writing are excluded and subject to additional charges.

2.3 The Company acts as an intermediary agent for Suppliers and shall not be liable for any negligence, failure, or default by the Suppliers.

  1. QUOTATION

3.1 Quotations are valid for seven (7) days and subject to availability.

3.2 Prices are only guaranteed upon full receipt of the deposit payment.

3.3 The Company reserves the right to withdraw any quotation before the deposit is received.

  1. PAYMENT

4.1 Deposit

A deposit of RM500 per person, unless otherwise stated, is mandatory and non-refundable. (Refer to Clause 5.0)

All payments are non-transferable without the Company’s written approval.

4.2 Payment Schedule – JOIN TOUR / OPEN TRIP / GIT

(a) One month after deposit payment:

Europe: RM2,000 per person
Japan: RM1,000 per person
Southeast Asia: RM800 per person

(b) One hundred and twenty (120) days before departure:

A minimum of 50% of the total package price must be paid.

(c) Forty-five (45) days before departure:

Full payment must be completed.

4.3 Payment Schedule – PRIVATE TOUR / PRIVATE TRIP / FIT

(a) Seventy-five (75) days before departure:

A minimum of 50% of the total package price must be paid.

(b) Forty-five (45) days before departure:

Full payment must be completed.

4.4 Failure of Payment

The Company reserves the right to:

(a) Cancel the booking;
(b) Forfeit all payments made;
(c) Terminate this Agreement without liability;
(d) Claim any outstanding balance if commitments have already been made to Suppliers.

  1. CANCELLATION AND AMENDMENTS

5.1 Deposits are non-refundable.

5.2 Changes of travel date or participant name are allowed only once and subject to tickets not being issued.

5.3 If tickets have been issued, all airline-related costs shall be borne by the Participant.

5.4 Cancellation within forty-five (45) days before departure will result in 100% forfeiture of all payments made.

  1. PRICING AND ADJUSTMENTS

6.1 Prices are based on prevailing rates as of the invoice date.

6.2 The Company reserves the right to sell packages at different prices without obligation for adjustment.

6.3 No “price match” claims shall be entertained.

6.4 Any increase in supplier costs after confirmation shall be borne by the Participant.

  1. ITINERARY

The Company reserves the right to amend the itinerary due to safety concerns, weather conditions, or instructions from authorities without compensation.

  1. DOCUMENTS AND VISA

The Participant is responsible for ensuring all travel documents are complete and valid. The Company shall not be responsible for immigration rejection or visa refusal.

  1. PARTICIPANT CONDUCT

The Company reserves the right to terminate the participation of any Participant who violates laws or disrupts the tour without any refund.

  1. HEALTH AND INSURANCE

All health-related risks are the responsibility of the Participant.

Participants are strongly encouraged to obtain travel insurance.

  1. FORCE MAJEURE

The Company shall not be liable for events beyond its reasonable control. Any refund shall be subject to amounts recovered from Suppliers.

  1. LIMITATION OF LIABILITY

The Company’s maximum liability shall be limited to the amount paid by the Participant.

The Company shall not be liable for any indirect or consequential losses.

  1. INDEMNITY

The Participant agrees to indemnify and hold harmless the Company against any claims arising from the Participant’s breach of this Agreement or misconduct.

  1. CHARGEBACK

The Participant shall not initiate any payment dispute or chargeback without reasonable basis after written agreement has been made.

  1. DATA PROTECTION (PDPA)

Participant data may be processed for travel management purposes in accordance with the Personal Data Protection Act 2010.

  1. ARBITRATION

Any dispute shall first be referred to arbitration in Malaysia in accordance with the Arbitration Act 2005.

  1. CLAIM LIMITATION PERIOD

Any claim must be made within twelve (12) months from the travel completion date.

  1. ENTIRE AGREEMENT

This Agreement supersedes all prior discussions, representations, or understandings.

  1. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  1. WAIVER

Failure to enforce any right under this Agreement shall not constitute a waiver of such right.

  1. ASSIGNMENT

The Participant may not transfer any rights under this Agreement without the Company’s written consent.

  1. ELECTRONIC SIGNATURE

Electronic signatures and digital confirmations shall be deemed valid and legally binding.

  1. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of Malaysia.

Any dispute shall be subject to the jurisdiction of the courts of Malaysia.
